Terms and conditions:

You must read carefully all terms and conditions below before participating in the voting and lucky draw. By participating in this voting and lucky draw (collectively the “Game”), you are indicating that you agree to be bound by the following terms and conditions:-

About Voting:

1. Voting Items: Best Actor (choose 1 out of 10 nominees); Best Actress (choose 1 out of 10 nominees); and Best Drama Series (choose 1 out of 24 nominees).
2. Voting Period: From 10 December 2012 3:00pm until 17 December 2012 3:00am.
3. You must be the holder of a valid Hong Kong Identity Card (“HKID Card”) in order to vote. No age restrictions for voting.
4. You can vote via TVB fun or tvb.com. 3 HK Mobile customers (“3 Users”) can vote by SMS.
   * If you are TVB fun registered user: TVB has already authenticated your identity when you first registered as user. You can vote directly upon entering the Game.
   ** If you are visitor of TVB fun: You must key in your mobile phone number and your HKID Card number upon entering the Game. TVB will send to you a verification code by SMS. You can vote after keying in the verification code.
   ***If you vote by tvb.com: You must key in your mobile phone number and your HKID Card number upon entering the Game. TVB will send to you a verification code by SMS. You can vote after keying in the verification code.
   ****If you are 3 User: 3 HK Mobile will invite its users to participate in the Game. You can vote by keying in your name as appeared on your HKID Card, your HKID Card number and the number of your chosen nominee(s) by replying in SMS.
5. For each voting item, your votes will only be counted as ONE only irrespective of how many times you vote. If you use the SAME HKID number and SAME mobile phone number to vote for the same voting item for more than ONCE; or if you use the SAME HKID number but DIFFERENT mobile phone numbers to vote for the same voting item; or if you use the SAME mobile phone number but DIFFERENT HKID Card numbers to vote for the same voting item; whether or not such voting are conducted through different voting tools (e.g. TVB fun and/or tvb.com and/or 3 mobile), and whether or not you vote for different nominees in the same voting item during different times of your voting, only your last vote for the same voting item will be calculated by TVB in determining the result.

About Lucky Draw:

6. Only voters who have attained 18 years old on or before 10 December 2012 are eligible to participate in the lucky draw (“Qualified Person”).
7. * If you voted as TVB fun registered user: You can enter the lucky draw directly after giving correct answer to a relevant question without the need to key in any information. You will have TWO (2) chances for lucky draw for each item you voted. Your maximum chances for lucky draw will be SIX (6) if you voted for all voting items.
   ** If you voted as TVB fun visitor: You must key in your name appeared on your HKID Card number and answer correctly to a relevant question before being eligible to enter the lucky draw. You will have ONE (1) chance for lucky draw for each item you voted. Your maximum chances for lucky draw will be THREE (3) if you voted for all voting items.
   *** If you voted by tvb.com: You must key in your name appeared on your HKID Card number and answer correctly to a relevant question before being eligible to enter the lucky draw. You will have ONE (1) chance for lucky draw for each item you voted. Your maximum chances for lucky draw will be THREE (3) if you voted for all voting items.
   **** If you voted by 3 SMS: You are eligible to enter the lucky draw if you are a Qualified Person. You will have ONE (1) chance for lucky draw for each item you voted. Your maximum chances for lucky draw will be THREE (3) if you voted for all voting items.
8. For each voting item, your chance(s) for lucky draw will not be accumulated and your chance(s) for lucky draw will be based on the voting tool you chose to cast your last vote, irrespective of how many times you voted for the same item. For example, if you voted as TVB fun registered user for one item, and subsequently voted the same item via 3 HK mobile services, your chance for lucky draw for that item will be based on your vote by 3 HK mobile services, i.e. ONE (1) only. Or, if you voted as TVB fun visitor and subsequently voted as TVB fun registered user for the same item, your chance for lucky draw for that item will be based on your vote as TVB fun registered user, i.e. TWO (2). Please refer to Clause 7 for the number of lucky draw entry chances.
9. The prize for the lucky draw is one [Mercedes Benz C180]. The lucky draw will be held on 17 December 2012 in the Special Programme “ Scoop” to be broadcast right after TVB Anniversary Awards 2012 on Jade Channel. TVB will contact the winner after the draw. If TVB could not reach the winner by calling the winner’s mobile phone number within 15 seconds, or if the winner so drawn fails to answer correctly the question asked by TVB, the winner will be disqualified and TVB will draw another winner and repeat the same procedures until a winner is successfully connected and has given correct answer to the question so that the prize could be given out during the Special Programme.
10. Upon verification of the winner’s identity, TVB will inform the winner to collect the prize in person. All processes of lucky draw and its results are supervised by professional accountants throughout.
11. All staffs of TVB, sponsors, and mobile application developer Cherrypicks, and their immediate family members are not eligible to participate in this lucky draw.
12. If TVB discovers at any time that any winner has submitted false information or failed to comply with these Terms & Conditions, TVB is entitled to forfeit the winner’s title and forfeit the prize. You shall not object to TVB’s decision.
13. You agree that upon winning this lucky draw, you will attend TVB’s interviews for the purpose of promoting this lucky draw and TVB’s business and TVB has the right to broadcast the interviews worldwide and in any format in perpetuity in all media.
14. TVB expressly disclaims any warranty in relation to the prize. You agree to discharge TVB and its group companies from all liabilities for any damages, losses, claims, litigation or any other legal responsibilities incurred or suffered by you arising from or in relation to your participation in the Game or the use of the prize.

Others:

15. TVB shall not be responsible for your loss due to the breakdown of any telecommunication device/receiver, or any telecommunication network’s failure or technical problems, or other third parties’ out of order issues, accidents or any other reasons affecting the operation of the Game, which in turn causing your voting unsuccessful or information for voting incomplete, or unsuccessful connection between you and TVB. TVB shall have the sole and final determination on the arrangement of voting and lucky draw.
16. You warrant that all personal data provided by you, including (i) the name on the HKID Card; (ii) the HKID number; and (iii) your mobile phone number; are true and accurate. Failure to do so may result in the invalidation of your rights to vote and/or lucky draw and your votes, and the retrieval of the prize by TVB.
17. You consent and permit TVB to collect and use your Personal Data in accordance with TVB’s Privacy Policy (Please refer to the Privacy Policy in the “Setting” of TVB fun and http://www.tvb.com/
    affairs/faq/policy/index_e.html of tvb.com) for the purposes of verifying your identity, the voting process and auditing the votes. You should read carefully our Privacy Policy before voting. In this connection, TVB’s appointed professional accountants are entitled to access and verify your personal data submitted.
18. If you participate in the Game as 3 User or TVB fun visitor: Your personal data stored in TVB archive will be deleted within 14 days from the completion of the Game.
19. If you are 3 User: By participating in the Game, you indicate that you have consented to the transferring and forwarding of your Personal Data collected by Hutchison Telecommunication (HK) Ltd. from Hutchison Telecommunication (HK) Ltd. to TVB, as well as your consent for TVB’s use of your Personal Data for the purposes as set out in these Terms & Conditions. TVB shall only be liable for the security of the storage and use of your Personal Data WHILST your Personal Data are in TVB’s custody. TVB is not liable for the collecting; storage and/or transfer of your Personal Data at Hutchison Telecommunication (HK) Ltd. Please refer to your User Agreement with Hutchison Telecommunication (HK) Ltd.
20. TVB has the right to modify these Terms & Conditions without prior notice. You have to check the updated version of Terms & Conditions posted in TVB fun or on www.tvb.com from time to time.
21. TVB has the absolute discretion to interpret and determine the details of this voting and lucky draw, the voting and lucky draw results, the prize arrangement and these Terms & Conditions. If there is any dispute, TVB shall have the right to make final determination.
22. If TVB reasonably believes that you have been using or abetting others to use inappropriate method or committing fraud to interrupt operation of TVB fun/ tvb.com/ 3 telecommunications; or interfere any part of this activity, causing technical problems or disorder or jeopardizing, damaging or affecting running of this activity, or its accuracy, fairness or smooth operation; or TVB detects any abnormal voting at the back end or front end, or any fraud on your part by misappropriating the Personal Data of any third party or impersonate any third party when participating the Game, TVB reserves all right to disqualify you and terminate your TVB fun account, and to claim any damage and loss suffered by TVB from you. You will also be criminally liable.
23. You shall be fully liable for and bear all risks of participating in the Game; TVB shall not be responsible for any of your claims in respect of the Game.
24. You shall also observe other terms and conditions applicable to TVB fun (Please refer to the “Setting” of TVB fun) and www.tvb.com (including but not limited to Prize Collection Notice and Disclaimer). In case of any inconsistences between the aforesaid other terms and conditions and these Terms & Conditions, these Terms & Conditions shall prevail.
